Plonty Terms & Conditions

You must be legally capable of entering into a binding agreement to use our Services or make purchases through our website.

If you are under the age of majority where you live, you may use the Services only with the involvement and permission of a parent or legal guardian.

You agree to use the Services only for lawful purposes and in accordance with these Terms.

Plonty sells food and nutrition products, including plant-based protein products.

We make reasonable efforts to accurately display product descriptions, ingredients, nutritional information, photographs, colors, sizes, pricing and other information.

However, packaging, product appearance and other details may occasionally differ from images displayed online.

We reserve the right to modify, improve, reformulate, discontinue or limit the availability of any product at any time, subject to applicable law.

Product availability is not guaranteed.

Information provided through the Plonty website, social-media channels, emails, recipes, articles, advertisements or other communications is provided for general informational and educational purposes only.

It is not intended to constitute medical advice, diagnosis or treatment.

Plonty is a food brand and does not provide medical or healthcare services.

Information about nutrition, ingredients, wellness or our products should not be used as a substitute for advice from a qualified healthcare professional.

Individual nutritional needs, sensitivities and reactions vary. You are responsible for reviewing product ingredients and nutritional information to determine whether a product is appropriate for you.

If you have a medical condition, food allergy, are pregnant or nursing, take medications, or have questions about whether a product is suitable for you, consult an appropriate healthcare professional.

Please review the ingredient list, Nutrition Facts panel and any allergen statements before consuming a Plonty product.

Although we aim to provide accurate ingredient and allergen information, manufacturing practices, suppliers and product formulations may change from time to time.

Always refer to the packaging of the product you actually receive for the most current ingredient, nutrition and allergen information.

If you have a severe allergy or medical dietary restriction, consult your healthcare provider before consuming the product.

By placing an order, you represent that all information you provide is accurate and complete and that you are authorized to use the payment method provided.

Your submission of an order does not necessarily mean that we have accepted it.

We reserve the right to refuse, limit or cancel an order where reasonably necessary, including because of:

• Product unavailability
• Pricing or listing errors
• Suspected fraud
• Unauthorized resale
• Payment issues
• Shipping restrictions
• Violations of these Terms

If we cancel an order after payment has been collected, we will refund the applicable amount as required by law.

Prices are displayed in U.S. dollars unless otherwise indicated.

Prices may change at any time without notice, but changes will not affect orders that have already been accepted except where permitted by law.

Taxes, shipping charges and other applicable fees may be added at checkout.

You authorize Plonty and its payment providers to charge your selected payment method for the amounts displayed and agreed to at checkout.

Payment processing may be performed by Shopify or other third-party payment processors.

Your use of a particular payment method may also be subject to your payment provider's terms.

Shipping times and delivery estimates are estimates only unless expressly stated otherwise.

Delays may occur because of carriers, weather, holidays, supply-chain issues or other circumstances outside our reasonable control.

Risk of loss and title to products transfer in accordance with applicable law and the shipping terms presented at checkout.

You are responsible for providing a complete and accurate delivery address.

Eligible first-time purchases may qualify for our 30-Day Guarantee.

Under the guarantee, eligible first-time customers may request a refund within 30 days of receiving their order, even when a product has been opened or substantially used, provided the applicable product packaging is physically returned and all other requirements are satisfied.

Customers are responsible for return shipping, and original shipping or delivery charges are non-refundable.

Complete eligibility requirements, bundle rules, subscription treatment and return instructions are contained in our Return & Refund Policy, which is incorporated into these Terms by reference.

In the event of any inconsistency relating specifically to a return or refund, the Return & Refund Policy will control to the extent permitted by law.

If you purchase a Plonty subscription, you are enrolling in a recurring purchase program.

The frequency, products, price, discount and other material subscription terms will be shown to you when you enroll.

Unless canceled, your subscription will automatically renew and your authorized payment method will be charged for each recurring order according to your selected schedule.

By enrolling, you authorize Plonty and its payment provider to automatically charge your payment method for recurring subscription orders until the subscription is canceled.

You may manage or cancel your subscription through the subscription-management tools provided to you, subject to any cancellation deadline disclosed when you subscribe.

To avoid being charged for an upcoming order, you must cancel before that order has been processed.

Canceling a subscription does not automatically cancel or refund an order that has already been processed.

A refund request under the Plonty 30-Day Guarantee does not automatically cancel your subscription.

Your first subscription order may qualify for the 30-Day Guarantee if it is also your first Plonty purchase and otherwise meets the guarantee requirements. Subsequent subscription orders are not covered by the first-purchase guarantee.

From time to time, Plonty may offer discounts, promotional codes, gifts, giveaways or other promotions.

Unless otherwise stated:

• Promotions have no cash value.
• Promotions may not be combined.
• Promotional offers may be limited to certain products, customers or time periods.
• Promotional codes may expire.
• Offers are subject to availability.
• Promotions may be modified or discontinued where permitted by law.

Unauthorized reproduction, resale or misuse of promotional codes is prohibited.

Specific promotional terms presented with an offer will control if they differ from this section.

Certain features may allow or require you to create an account.

You agree to provide accurate and current information and to update it when necessary.

You are responsible for maintaining the confidentiality of your password and login information and for activity conducted through your account.

Please contact us promptly if you believe your account has been accessed without authorization.

We may suspend or terminate accounts being used fraudulently, unlawfully or in violation of these Terms.

You may not use the Plonty website or Services to:

• Violate any applicable law
• Commit or facilitate fraud
• Impersonate another person
• Interfere with website operation or security
• Introduce viruses, malware or harmful code
• Attempt unauthorized access to accounts or systems
• Scrape or harvest website information using automated means except where permitted by law
• Copy or exploit website content for unauthorized commercial purposes
• Infringe intellectual-property rights
• Harass or harm others
• Make purchases for unauthorized commercial resale
• Otherwise misuse the Services

We may restrict access to the Services where we reasonably believe these Terms have been violated.

The Plonty website and its contents—including the Plonty name, logos, branding, product designs, packaging, photographs, graphics, videos, recipes, written content, website design and other materials—are owned by or licensed to Plonty and are protected by intellectual-property laws.

We grant you a limited, revocable, non-exclusive and non-transferable right to access the website for your own lawful personal use.

Nothing in these Terms transfers ownership of Plonty's intellectual property to you.

You may not reproduce, modify, distribute, sell, exploit or create derivative works from protected Plonty content without permission, except as permitted by law.

You may have opportunities to submit reviews, photographs, comments, testimonials, recipes or other content (“User Content”).

You remain responsible for the content you submit.

You represent that:

• You own or have permission to submit the content.
• The content does not infringe another person's rights.
• The content is truthful to the best of your knowledge.
• The content is not fraudulent, unlawful or intentionally misleading.

When you voluntarily submit User Content directly to Plonty for publication, you grant Plonty a non-exclusive, worldwide, royalty-free license to use, reproduce, display and distribute that content in connection with our website, products and marketing, subject to applicable law.

If we would like to use social-media content or other content in a way requiring additional permission, we may ask for your consent.

We reserve the right to remove or decline to publish User Content.

Our Services may integrate with or link to third-party providers, including:

• Shopify
• Payment processors
• Subscription platforms
• Shipping providers
• Review platforms
• Social networks
• Analytics providers
• Advertising platforms

We do not control third-party websites or services and are not responsible for their content, availability, security or privacy practices.

Your use of a third-party service may be governed by that provider's own terms and privacy policies.

By providing your email address and opting into marketing communications, you may receive promotional communications from Plonty.

You may unsubscribe from promotional email at any time using the unsubscribe link contained in the communication.

We may continue to send transactional messages relating to orders, accounts, subscriptions, refunds, security or customer service even if you opt out of promotional marketing.

If Plonty introduces SMS marketing, separate SMS terms and consent disclosures may apply.

We work to keep GetPlonty.com available and functioning properly, but we cannot guarantee uninterrupted or error-free access.

We may temporarily suspend, change or discontinue portions of the Services for maintenance, updates, security or other business reasons.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE, SERVICES AND WEBSITE CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WE DO NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, SECURE OR FREE OF HARMFUL COMPONENTS.

Nothing in this section excludes any warranty or right that cannot lawfully be excluded.

Our products remain subject to any warranties or consumer protections required by applicable law and to the commitments expressly stated in our Return & Refund Policy.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HEMPY LLC D/B/A PLONTY AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE WEBSITE OR SERVICES.

TO THE EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM A CLAIM RELATING TO A PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO PLONTY FOR THE PRODUCT OR ORDER GIVING RISE TO THAT CLAIM.

These limitations do not apply where liability cannot legally be limited or excluded, including rights provided by applicable consumer-protection law.

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Hempy LLC d/b/a Plonty and its affiliates, officers, employees and agents from claims, liabilities, losses or reasonable expenses arising from:

• Your unlawful misuse of the Services
• Your violation of these Terms
• User Content you submit that infringes the rights of another person

Nothing in this provision requires a consumer to indemnify Plonty where doing so would be prohibited by law.

You may stop using the Services at any time.

We may suspend or terminate access to an account or portion of the Services if we reasonably believe there has been fraud, misuse, unlawful activity or a material violation of these Terms.

Sections that by their nature should survive termination—including intellectual property, liability and dispute provisions—will continue to apply.

Our collection and use of personal information is governed by the Plonty Privacy Policy.

Please review that policy to understand how Plonty collects, uses and discloses personal information and the privacy rights that may be available to you.

We may update these Terms periodically to reflect changes in our business, products, Services or legal requirements.

When we update the Terms, we will revise the effective date at the top of this page.

Where legally required, we will provide additional notice of material changes.

Your continued use of the Services after updated Terms become effective constitutes acceptance to the extent permitted by applicable law.

To the extent permitted by applicable law, these Terms and disputes arising from them will be governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.

Nothing in this provision deprives you of consumer-protection rights that cannot be waived under the laws applicable to you.

If any provision of these Terms is found unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

These Terms, together with our Privacy Policy, Return & Refund Policy and any additional terms presented in connection with a particular purchase, subscription or promotion, constitute the agreement between you and Plonty concerning the Services to the extent permitted by applicable law.
